Special Needs Trusts

A Special Needs Trust is a legal document that allows you to provide for the needs of a disabled loved one without causing him or her to become ineligible for government assistance or other needed benefits. Because most governmental assistance programs for people with handicaps or disabilities have strict resource and income limits, you may be fearful that establishing a trust or including a disabled child in your Will could cause him or her to lose desperately needed assistance. By creating a carefully drafted Special Needs Trust (also known as a “Supplemental Needs Trust”), however, you can provide for the supplemental needs of a loved one without jeopardizing his or her eligibility for Medicaid, SSI, SSD, Section 8 Housing Assistance, and other vital benefit programs.
